We value your trust and to honour that trust, Wengo adheres to ethical standards in gathering, using, and safeguarding any information you provide. Klaversof Techsolutions LLP (operating the brand name Wengo), is a Limited Liability Partnership (LLP) (hereinafter referred as Company/company), incorporated in India, for providing various software and technical solutions. This privacy policy governs your use of the application ‘Wengo' ('Application'), and other associated products and services managed by the Company. Please read this privacy policy ('Policy') carefully before using the Application, services and products, along with the Terms & conditions of Use ('T&C') provided on the Application (APP). Your use of the Application or services in connection with the Application or products ('Services'), or registrations with us through any mode including through SD cards, tablets, mobiles or other storage/transmitting device shall signify that you understand, agree and consent to this Privacy Policy and agree to be legally bound by the same. If you do not agree with the T&C of this Policy, do not use the Application, our products or avail any of our Services. User Provided Information The Application/services/products obtain the information you provide when you download or register for the Application or services or products. When you register with us, you generally provide amongst other information (a) your name, email address, location, phone number, college name, class of study and year; (b) transaction-related information such as when you make purchases, respond to any offers, or download or use applications or services from us; (c) information you provide us when you contact us for help or giving feedback or for queries. The said information collected from the users could be categorized as “Personal Information”, “Sensitive Personal Information”, and “Associated Information” as per the prevailing law. Personal Information, Sensitive Personal Information and Associated Information (each as individually defined under the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (the “Data Protection Rules”)) as amended from time to time, shall collectively be referred to as 'Information' in this Policy. We may use the Information to contact you from time to time, to provide you with the Services, important information, required notices, notifications and marketing promotions. We will ask you when we need more information that personally identifies you (personal information) or allows us to contact you. We will not differentiate between who is using the device to access the Application, Services or products, so long as the log-in/access credentials match with yours. In order to make the best use of the Application/Services/products and enable your Information to be captured accurately on the Application/Services/products, it is essential that you have logged in using your own credentials. You may choose, at all times, the option to not provide the Personal Information or Sensitive Personal Information, which we seek from you. Further, you shall, at any time while using the Application/Services/products, also have an option to withdraw your consent given earlier to us to use such Personal Information or Sensitive Personal Information. Such withdrawal of the consent is required to be sent in writing to us at the contact details provided in this Policy below. In such event, however, the Company fully reserves the right not to allow further usage of the Application or provide any Services/products thereunder to you. Automatically Collected Information In addition, the Application/products/services may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application/Services/products. As is true of most Mobile applications, we may collect other relevant information as per the permissions that you provide. We use an outside billing/credit card processing company to bill you for goods and services which operate as per their usage terms and conditions. By having a Wengo account you have explicitly given consent for us to capture images (followed by analysis), camera/mic permissions to make video calls and record the same. Use of your Personal Information Our primary goal in collecting your Personal Data and other personal information is to provide you a safe, efficient and smooth experience. We may use the collected Information to analyse trends, to conduct research, to administer the Application/Services and products, to learn about each user's usage patterns and movements around the Application/Services and products and to gather demographic information and usage behaviour about our user base as a whole. Aggregated and individual, anonymized and non-anonymized data may periodically be transmitted to external service providers to help us improve the Application, products and our Services. We will share your information with third parties only in the ways that are described below in this Policy. We may use the individual data and behaviour patterns combined with personal information to provide you with personalized content, and improve your experience. Third parties provide certain services which we may use to analyse the data and information to personalize, drive insights and help us better your experience or reach out to you with more value added applications, products, information and services. However, these third party companies do not have any independent right to share this information. We do not sell, trade or rent your Information to any third party unless, we have been expressly authorized by you either in writing or electronically to do so. We may at times provide aggregate statistics about our customers, traffic patterns, and related site information to reputable third parties, however this information when disclosed will be in an aggregate form and does not contain any of your Personally Identifiable Information. Wengo will occasionally send email notices or contact you to communicate about our Services, products and benefits, as they are considered an essential part of the Services/products you have chosen. We may disclose Information: -to enforce applicable T&C, including investigation of potential violations thereof; -as required by law, such as to comply with a subpoena, or similar legal process; -with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this Policy; -when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, address security or technical issues or respond to a government request; -with Other Corporate Entities that are committed to serving your online needs and related services, throughout the world. Such data will be shared for the sole purpose of enhancing your browsing experience and providing our services to you. To the extent that these entities have access to your information, they will treat it at least as protectively as they treat information they obtain from their other members. It is possible that We and/or its subsidiaries, or any combination of such, could merge with or be acquired by another business entity. Access to your Personal Information We will provide you with the reasonable means to ensure that your Personal Information is correct and current. If you have filled out a user profile, we will provide an obvious way for you to access and change your profile from our Application/Services/products, as needed. We adopt reasonable security measures to protect your password from being exposed or disclosed to anyone. Cookies We transfer cookies (small files containing a string of characters) to your mobile or computer, thereby uniquely identifying your browser. Cookies are used to track your preferences, help you login faster, and aggregated to determine user trends. This data is used to improve our offerings, and services. Links We may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve our customized content. Clicking on links may take you to sites outside our domain/Application. We are not responsible for the privacy practices of outside domains/Applications. This Privacy Policy applies solely to information collected by our Application. You acknowledge and agree that We are not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such Websites or resources. These third-party service providers and Third-Party Sites may have their own privacy policies governing the storage and retention of your personal information that you may be subject to. We recommend that when you enter a Third-Party Site, you review the Third Party Site’s privacy policy as it relates to safeguarding your personal information. We use third-party advertising companies to serve ads when you visit the Website. Alerts We may alert you by email or phone (through sms/WhatsApp/call/notifications) to inform you about new service offerings or other information which we feel might be useful for you and you indemnify the Company against any violation of applicable UCC laws. Consulting We use third parties to help us provide services to You including the fulfillment of service, processing of payments, monitoring site activity, conducting surveys, maintaining our database, administering emails, and administering contents, and to provide aggregate, comparative information on the performance of our website to us and a select group. Public Forums When you download and register on our Application you provide your personal information such as display photo, name of college, level of study, year, branch (stream) etc., mobile number which may be made available to all users, and will be in the public domain. Anyone who downloads the Application and registers with the same college name will be able to see your information. All such sharing of information is done at your own risk and you understand and agree with the same. Security We are concerned about safeguarding the confidentiality of your Information. We provide physical, electronic, and procedural safeguards to protect Information we process and maintain. For example, we limit access to this Information to authorized employees only who need to know that information in order to operate, develop or improve our Application/Services/products. Please be aware that, although we endevour to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches. How long do we retain user data? Currently, we plan to retain user data while an account is active and for at least one hundred and eighty days afterward. We may alter this practice according to legal and business requirements. For example, we may lengthen the retention period for some data if needed to comply with law or voluntary codes of conduct. Unless otherwise prohibited, we may shorten the retention period for some types of data if needed to free up storage space. Log information When you access our Application, our servers automatically record information that your browser sends whenever you visit Application. These server logs may include information such as your web request, internet protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser. User communications When you send an email or other communication to us, we may retain those communications in order to process your inquiries, respond to your requests and improve our Services. You are advised to review this Policy regularly for any changes, as continued use is deemed approval of all changes. Your Consent We believe that, every user of our Application/Services/products must be in a position to provide an informed consent prior to providing any Information required for the use of the Application/Services/products. By registering with us, you are expressly consenting to our collection, processing, storing, disclosing and handling of your information as set forth in this Policy now and as amended by us. Your information will be processed in any way, including, but not limited to, collecting, storing, deleting, using, combining, sharing, transferring and disclosing information. You agree to check the privacy policy and T&C of usage at least once every year which shall be taken as your consent with them. Your continuation with the usage of Application/services/product shall be your consent with the privacy policy and T&C of the company. Further that in case of non-compliance with rules and regulations, privacy policy or user agreement for access or usage of the computer resource, the company has the right to terminate the access or usage rights of the users to the computer resource immediately or remove non-compliant information or both, as the case may be. Conditions of use It is not assured that this Application, its servers, or email sent by us or on our behalf are virus free though efforts are made for towards this end. We will not be liable for any damages of any kind arising from the use of this Application, including, but not limited to compensatory, direct, indirect, incidental, punitive, special or consequential damages, loss of data, goodwill, business opportunity, income or profit, loss of or damage to property and claims of third parties. Governing Law and Jurisdiction The Governing Law shall be as applicable in India and the place of Jurisdiction shall be Delhi (New Delhi). In the event of any dispute arising between the parties with respect to this Agreement, the same will be resolved through a two-step Alternate Dispute Resolution mechanism. Stage 1: Mediation. In case of a dispute, the matter will first be attempted to be resolved by a sole mediator who is a neutral third party and will be selected at the mutual acceptance of a proposed mediator by both parties. Both parties may raise a name for sole mediator and in case both parties accept the proposed name, the said person shall be appointed as sole mediator. In any case the parties are not able to reach a consensus within two proposed mediators, the Company reserves the right to decide who the final mediator is. The decision of the mediator is not binding on both parties, however the parties in good faith will attempt to bind by the decision. Stage 2: Arbitration. In case that mediation does not yield a result suitable or preferred by any one of the parties, arbitration may follow and the matter shall be referred to the Sole Arbitrator and the arbitration shall be in accordance with Arbitration and Conciliation Act of 1996. The language of arbitration proceeding shall be English. The seat and place of arbitration shall be Delhi, and the decision of the Arbitrator shall be final and binding on both parties herein. If the dispute cannot be resolved by this two-step Alternate Dispute Resolution mechanism, it shall be referred to the exclusive jurisdiction of courts in Delhi, India and shall be governed by the Indian laws.
